La presente investigación pretende analizar someramente el derecho a la verdad haciendo hincapié en su acepción extrajudicial y, en particular, en la memoria histórica que ha sido abordada mediante la sentencia T - 281 del 2021, en la que en consecuencia al proceso instaurado por el general Marcos Evangelista Pinto Lizarazo en contra del mural urbano ¿Quién dio la orden? Se evidencia la protección constitucional del derecho a la memoria histórica en virtud del pronunciamiento de la Corte Constitucional.

El presente trabajo persigue aclarar y explicitar los fundamentos ontológicos presentes en el tratado Realidad y substancia, de Antonio Escohotado. De modo sintético el sujeto se funda en la nada el recorrido de la esencia, que se redefinirá como invenir para alcanzar el mayor grado de objetividad en el acto, en la actividad de lo real. Al fin, inmerso en una realidad dinámica se postula la vida, ya no como sujeto, para ahondar en la experiencia como un tránsito en el (...) que el conocimiento es posible dentro de lo indeterminado. The essays in this volume concern the topic of legal rights, how they are related to morality, the place of rights on moral theory, and the legal recognition of rights.

Many writers interested in Kelsen's concept of validity state that it is primarily related to such issues as the identity of a legal system, the membership of particular norms in a legal system, its internal consistency, and so on. The result is that for many, Kelsen's concept of validity bears no affinity to the idea of validity prevailing in traditional legal philosophy. This chapter argues that this reading of Kelsen's concept of validity is mistaken. Proponents of this reading have been (...) led to disregard important aspects of Kelsen's theory, formulating unwarranted and tortuous interpretations of it in order to show how it deals with issues that are erroneously supposed to be primarily connected to its concept of validity. It is shown that Kelsen's theory, like traditional philosophical accounts of law, equates the validity of law with its binding force and its existence, and that it conceives of the ascription of validity as a normative judgement. This reflection on Ethics in One Hundred Years of Solitude is divided in two main parts and issues. In this, the first one, thanks to the intertextual method, the author makes a journey throughout the structure, the characters and the focus of the novel to argue that ethics described there by Gabriel García Márquez is rooted in biblical myths, and how its use is a tool that gives unity to the work, and allows the author to openly reveal the human (...) condition. Political fact-checkers evaluate the truthfulness of politicians’ claims. This paper contributes to an emerging scholarly debate on whether fact-checkers treat political parties differently in a systematic manner depending on their ideology (bias). We first examine the available approaches to analyze bias and then present a new approach in two steps. First, we propose a logistic regression model to analyze the outcomes of fact-checks and calculate how likely each political party will obtain a truth score. We test our model with a (...) sample of fact-checks from Newtral, a major Spanish fact-checker. Our model would signal bias under two assumptions: a) all political parties are on average equally accurate in their statements; b) the verification method gives precise instructions and is implemented systematically. We investigate this second assumption with a series of interviews with Newtral fact-checkers. We show that standard verification protocols are so loosely implemented that fact-checks reflect a set of journalistic decisions, rather than a bias in the statistical sense. We call for a more rigorous definition of verification methods as a pre-requisite for an unbiased assessment of politician’s claims. (shrink)

Este artículo es el resultado de una investigación del programa de Maestría en Educación de la universidad la Gran Colombia; se propuso como objetivo general determinar cómo construyen la categoría “valor” estudiantes de grado once de dos colegios de la ciudad de Bogotá, con edades que oscilan entre quince y diecinueve años respectivamente. El enfoque metodológico fue de carácter cualitativo en el cual se utilizaron las técnicas de recolección de información: grupos focales y entrevistas a profundidad, que tuvieron el propósito (...) de recoger e interpretar la asignación de sentidos y representaciones expresadas en las narrativas de los actores participantes. Algunos de los hallazgos sugieren que las percepciones de la población objeto de estudio sobre la categoría “valor” están relacionadas con procesos de subjetivación que se construyen en la vida cotidiana en dinámicas complejas y no necesariamente lineales, como resultados de acuerdos sociales. De otra parte, existe una tendencia significativa a construir la categoría “valor” de acuerdo con las necesidades, intereses y motivaciones que se generan en el contexto escolar, lo que produce conflictos, contradicciones y valoraciones morales que muchas veces devienen en lucha de fuerza con las instituciones. Se destaca entre otras conclusiones, el juego en que se sumergen los estudiantes a partir de prácticas éticas asociadas a la categoría “valor” de carácter teleológico, porque las conductas intentan evitar un castigo o alcanzar un premio; y autotélicas porque los comportamientos producen felicidad en el hacer. Este artículo analiza la potencia desestabilizadora de la gramática política de la Educación Sexual Integral y su posibilidad de gestar en las escuelas espacios incluyentes en un contexto socio-cultural conservador. Se describe la puesta en acto de la ESI en una provincia del Noroeste Argentino a través de datos relevados en la consulta a estudiantes efectuadas por el Operativo Aprender en 2019 y registros cualitativos de trabajo de campo en escuelas que acogen sujetos de la diversidad sexo-genérica.

O presente trabalho é uma tradução do espanhol para o português de três contos do livro "Cuentos de Amor de Locura y de Muerte" do escritor uruguaio Horacio Quiroga. Os contos selecionados são: "La Gallina Degollada", "El Almohadón de Plumas" e "A la Deriva". Os textos traduzidos ficaram com os seguintes nomes: "A Galinha Degolada" "O Travesseiro de Penas" e "À Deriva".

The objective of this article is to analyse cultural influences when French companies cooperate with Mexican companies (subsidiaries of the French, established in Mexico) in the field of automotive manufacturing. An OEM supplier and a final assembly plant were selected to perform the study. Interviews with the workers, supervisors and managers have been performed. Case studies were collected in order to analyse the problems and to illustrate technical as well as cultural solutions. The analysis showed that important differences and coincidences (...) in the manufacturing solutions could be explained from the cultural (French and Mexican) standpoint. The conclusions integrate some recommendations for French and Mexican companies that are in actual cooperation or that are planning to globalise in the corresponding countries. (shrink)

Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Los trabajos de este libro esperan problematizar este y otros ejes, explorando las perspectivas de los ?clásicos? de la escuela francesa en epistemología (Bachelard, Canguilhem, Althusser, Foucault, etc.), las relaciones entre los mismos y los diálogos que cabe establecer entre estos y otras corrientes de pensamiento. ABSTRACT:A wide range of research uses patterns of genetic variation to infer genetic similarity between individuals, typically referred to as genetic ancestry. This research includes inference of human demographic history, understanding the genetic architecture of traits, and predicting disease risk. Researchers are not just structuring an intellectual inquiry when using genetic ancestry, they are also creating analytical frameworks with broader societal ramifications. This essay presents an ethics framework in the spirit of virtue ethics for these researchers: rather than focus on (...) rule following, the framework is designed to build researchers’ capacities to react to the ethical dimensions of their work. The authors identify one overarching principle of intellectual freedom and responsibility, noting that freedom in all its guises comes with responsibility, and they identify and define four principles that collectively uphold researchers’ intellectual responsibility: truthfulness, justice and fairness, anti-racism, and public beneficence. Researchers should bring their practices into alignment with these principles, and to aid this, the authors name three common ways research practices infringe these principles, suggest a step-by-step process for aligning research choices with the principles, provide rules of thumb for achieving alignment, and give a worked case. The essay concludes by identifying support needed by researchers to act in accord with the proposed framework. (shrink)

The aim of this paper is to prove how what is apparently a mistake made by Plutarch, wheter deliberate or not, in his reference to the arson attack of Caesar´s soldiers in Alexandria as the end of the famous Library, show us the common sense of the term “bibliotheke” from that time up to now. Coming to this conclusion has required a detailed analysis of the Library of Alexandria since its birth applying Aristotelian doctrine to its configuration not only as (...) an organized space for books but also as an imaginary reading room from which the helenistic world of relations is established. In a second approach, we focus the attention on the change occurred in this collection with the introduction of alphabetical order and, then, with the philological activity of Callimachus. As a result of his Pinakes, the platonic concept of daimon, “guide”, became the first characteristic o a philologist or librarian. Using the information ordered in the Pinakes anybody could be a librarian and find a library anywhere. The old megále bibliotheke of Alexandría remains only with the idea of the conservation of original papyrus. This is de reason of the enigmatic sentence of Plutarch announcing the end of this situation caused by the action of the fire. (shrink)

It is proposed that subconscious retro-predictions in conjunction with brain state update cycles are instrumental in the physiological generation of conscious sensations and perceptions, and in all abstract thought. In this paper the hypothesis is supported by conducting a detailed a re-evaluation of the self-referential statements in Set Theory and Formal Logic known as antinomies. This study concludes that the recursive behavior exhibited by abstract enigmas such as "Russell’s Paradox" is analogous to the oscillations typical of bistable perceptual phenomena.

The process of assessing executive functions through behavioral observation scales is still under theoretical and empirical construction. This article reports on the analysis of the factorial structure of the EOCL-1 scale that assesses executive functions, as proposed by the theory developed by Luria, which has not been previously considered in this type of evaluation. In this scale, the executive functions taken into account are error correction, internal behavioral and cognition regulatory language, limbic system conscious regulation, decision making, future consideration of (...) consequences of actions, goal-directed behavior, inhibitory control of automatic responses, creation of new behavioral repertoires, and cognitive–behavioral activity verification. A variety of validity and reliability analyses were carried out, with the following results: an adequate internal consistency level of executive functions between α = 0.70 and α = 0.83, significant convergent validity with a scale that assesses frontal deficits between r = −0.07 and r = 0.28, and the scale’s construct validity that proposes a model with an executive central factor comparative fit index = 0.93, root mean square error of approximation = 0.04, standardized root mean square residual = 0.04, and x2 = 789.29, p = 0.001. The findings are discussed based on previous literature reports and in terms of the benefits of using a scale to assess the proposed executive functions. (shrink)

This paper presents an overview of my work in philosophy from my first book on Friedrich Schiller and the political sublime to my most recent project on listening to traumatic forms of violence. Starting with a reflection on the autobiographical character of philosophy, I propose to take up the question of an aesthetic dimension of philosophical critique, where aesthetics is understood as an always already embodied perspective on the world, on truth, and on philosophical activity, as well as an always (...) already political realm, where the distribution of sense pre-determines our approach and articulation of experience. Departing from aesthetics understood and deployed as critique, the paper moves on to ask about the specific frameworks of sense or grammars that determine in advance the conditions of audibility in the realms of memory-building and history-making—particularly in those contexts where historical, political, and institutional forms of violence produce silencing and erasure. Putting in dialogue the latter with decolonial studies, I (re)interpret “traumatic violence” as a colonizing form of violence, understanding that one of its central aspects is that it is not only an assault on life but on the conditions of production of sense that make life legible as such. In this context, my project on grammars of listening seeks to carefully unpack these complex intersections while also explaining why I believe that a radical form of listening is an essential subversive/imaginative strategy against traumatic/colonial violence. En este artículo se presenta una revisión bibliográfica de la novela Terra nostra, de Carlos Fuentes, y propicia diálogos que evidencian su actualidad y su relación interdisciplinar con la filosofía, la historia, el arte, la sociedad y la cultura. En los criterios estructurales se distinguen estas temáticas: mito e identidad, relaciones con el otro, imagen y memoria, y la reconstrucción de lo que somos y seremos. Se tuvieron en cuenta franjas temporales de ocho años, desde el momento de su (...) publicación, 1975, hasta el año 2015. Los estudios destacan los problemas de la identidad latinoamericana, la intertextualidad, la multiculturalidad y la conquista; revelan su actualidad en el siglo XXI a través del mestizaje, las tradiciones culturales del Viejo y el Nuevo Mundo, y los otros mundos; y expresan, así, la necesidad de reconstruir un nuevo humanismo. The objective of this work is to analyse and provide solutions to the problems encountered during the engineering processes undertaken by global companies established in Mexico. The considerations for this study are not only centred on the engineering work but also on its relation to the culture and the people within which this process takes place. One automobile consortium with a huge assembly plant in Mexico is researched, and a case study is developed for its engineering change process. The time (...) delays in carrying out an engineering change are analysed. Important findings are reported in the areas of software operation, design process, engineers training, teamwork, adaptation to different cultures, technology transfer and language barriers. Concurrent engineering is proposed as a means to gain the time reduction sought by the plant in Mexico. Special attention is recommended for the education of personnel and their preparation for an important organisational change. (shrink)
